TYPES OF DATA PROCESSED AND PURPOSES OF PROCESSING

Browsing data

The computer systems and software procedures used to operate this site acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols.

This category of data includes the IP addresses or domain names of the computers and terminals used by users, the addresses in URI/URL (Uniform Resource Identifier/Locator) notation of the resources requested, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.), as well as other parameters relating to the user’s operating system and computer environment.

These data, necessary for the use of web services, are also processed for the purpose of:

• obtain statistical information on the use of the services (most visited pages, number of visitors by time slot or daily, geographical areas of origin, etc.);
• check the proper functioning of the services offered.

Browsing data do not persist for more than seven days and are deleted immediately after their aggregation (except for any need to ascertain crimes by the judicial authorities).

Data communicated by the user

The optional, explicit and voluntary sending of messages to Yookye’s contact addresses, as well as the completion and submission of the contact form on this site, entail the acquisition of the sender’s contact data, necessary to respond, as well as any personal data included in the communications.

Data related to tastes and habits, including the result of processing and analysis, will be processed only with the user’s explicit consent in this regard.

Cookies and other tracking systems

No use is made of cookies for user profiling, nor are other tracking methods employed.

Instead, use is made of session (non-persistent) cookies in a manner strictly limited to what is necessary for the safe and efficient navigation of the site. Why we process your data – purpose and storage

   – In order to allow you to browse our website, it is necessary to collect and process certain information about your device (such as, for example, your IP address): this data is collected from time to time due to the normal operation of the website, which involves a flow of information from our servers to your terminal and vice versa. The retention of data, for these purposes, is strictly related to the time of transmission of information over the networks.

   – Other purposes for which your data may be processed and retained are related to the need to fulfill certain obligations imposed by various industry regulations and for administrative-accounting needs (e.g., in cases where it is necessary to invoice the service you requested, the purpose would be based on the need to fulfill tax obligations). In these cases, the storage is for the time imposed by industry regulations (e.g., due to the provisions of Article 2220 of the Civil Code, i.e., for 10 years).

   – Any contact, complaint or request for assistance, forwarded through the appropriate forms made available to you within the site, or sent to our e-mail address, involve the processing of your personal data, to the extent strictly necessary to follow up on your specific requests. The storage of your data is strictly related to the period necessary to follow up on these requests.

 – The e-mail address may be used to send you advertising material, carry out direct sales, market research and customer satisfacion, and in general for marketing purposes, as well as sending newsletters. The contacts we will take with you could be through traditional channels (paper or telephone by operator) and automated (newsletters by e-mail, SMS, MMS, push notifications, etc.). This purpose will be pursued if you give us your explicit consent in this regard or on the basis of your legitimate interest in direct marketing in accordance with Recital 47 of the Regulations. Notwithstanding your ability to revoke your consent at any time, your data for this purpose will be retained for 2 years after collection.

   – Any further explicit consent, will allow us to carry out, on the basis of the data provided by you, activities of analysis of your tastes and habits, in order to offer you products and services more akin to your needs. Also in this case, without prejudice to the possibility of always revoking consent, the storage of your data will last 1 year from its collection.

RECIPIENTS OF THE DATA

Personal data may be communicated to subjects outside the Company (natural or legal persons), but only if strictly essential and pertinent to the pursuit of the purposes mentioned above: these subjects will be appointed as Data Processors and contractually obliged to comply with what Yookye will indicate to them for the pursuit of the objectives of protection and safeguard of personal data.

Should such parties not assume the role of data processors, we will make arrangements so that they provide adequate guarantees for the protection of personal data (communication will take place solely in pursuit of the purposes stated above). It should be noted, however, that Yookye is in no way responsible for any non-compliance with data protection regulations or wrongdoing perpetrated by the aforementioned parties.

By way of example, the categories of recipients of your data are:

• IT services maintenance companies
• Companies providing cloud and other virtualization services
• Professional firms (e.g., accountants, for bookkeeping)

The personal data collected is also processed by Yookye’s authorized personnel/subjects acting on the basis of specific instructions given regarding the purposes and methods of such processing.

RIGHTS OF DATA SUBJECTS

In your capacity as a data subject, you have the rights set forth in Articles 15-22 EU Regulation No. 679/2016, namely the rights to:

• right of access: right to obtain from the data controller confirmation as to whether or not personal data concerning you are being processed and if so, to obtain access to the pesonal data;
• Right to rectification and/or integration of inaccurate personal data;
• right of cancellation in the presence of the conditions of Article 17 EU Regulation No. 679/2016 paragraph 1, excluded in the cases referred to in paragraph 3 of the same article;
• right to limitation of processing;
• right to data portability;
• right to object to processing;
• right not to be subjected to a decision based solely on automated processing, including profiling, which produces legal effects concerning the data subject or which affects the data subject in a similar significant way.

RIGHT TO COMPLAIN

Data subjects who believe that the processing of personal data relating to them carried out through this site is in violation of the provisions of the Regulation have the right to lodge a complaint with the Guarantor, as provided for in Article 77 of the Regulation itself, or to take legal action (Article 79 of the Regulation).
